Terms of Service

The Objective of These Rules

Presented here for the benefit for our clients is a brief review of QX.net's policies governing the rules and regulations for all users on our network. To be clear, any user of any QX.net service is subject to them. Additionally, they represent no bold or strange take on the typical Terms of Service policies most service providers maintain.

Of course, these rules exist for the protection of the interests of QX.net. But they also serve to protect the best interest of you, the user, as well as the Internet itself. That said, we here at QX.net believe that given the importance of the purpose they serve, they have to be stated clearly and firmly. Even if they sound harsh or unfriendly. Typically, the vast majority of our users never come close to violating these rules. So there should be no fear of any accidental breach of policy.

As we wish to keep our regulations to a minimum, the rules presented here cover all of our most salient concerns. Failure to comply with them may result in the immediate termination of your account. In such instances, no refund of any kind will be provided.

We are generally nice folks with a reputation for being reasonable. Should you have a problem with any aspect of our Terms of Service, bring it to us. Given the potential consequences, we strongly advise you not be creative about circumventing our rules.

 

Remember This

QX.net maintains the confidentiality of your account information. So too must our users be mindful of keeping access to the login information for their account(s) and services secure. Unless it is clearly and indubitably obvious that your account has been compromised, QX.net must assume that all actions taken with your account are done by your hand or at least with your knowledge. In which case, you will be held responsible for anything done on your account and/or with your services. This includes, but is not limited to, signing up for new services, criminal activity online, etc. The importance of this cannot be overstated: KEEP YOUR ACCOUNT INFORMATION SECURE.

Email Disclaimer

Email users are subject to receiving (but not limited to) SPAM email, Phishing email, Spoofing email, virus email, Scam email, and all other types email that may be considered illegitimate. Email users understand that the server filtering is best effort and uncaught messages will occur. It is the sole responsibility of the email user to determine what type of email they are receiving. Email users shall hold harmless, defend and indemnify QX.net, its executives, officers, managers, and subsidiaries from any and all actions, claims, charges, suits and judgments whatsoever that arise out of the performance or nonperformance of the services provided.

Technology User Disclaimer

Users of technology supplied by, designed by, or provided by QX.net are subject to the following. The user shall hold harmless, defend and indemnify QX.net, its executives, officers, managers, and subsidiaries from any and all actions, claims, charges, suits and judgments whatsoever that arise out of the performance or nonperformance of the services provided. These services include but are not limited to Internet Connectivity, Voice Services, SDWAN Service, Email Service, Hosted Firewall Service, Data Center (co-location) Service, Web Hosting Service, Data Storage Service, Virtual Servers (VPS), and Consulting Services.

Cancellation of Services

To cancel services without a service contract you must call QX.net at the telephone number provided on this site. All cancellation requests must be received by phone. QX.net cannot cancel an account via written request, email, or any form of correspondence other than a phone call. Clients wishing to cancel must call the main support number and work with a QX representative to cancel services. No third party may cancel an account on the client's behalf. Only the client(s) listed on the account will be permitted to cancel services. In the event that a client wishing to cancel service fails to call QX.net to cancel, the account will remain open until a call is placed to our office. Termination will be effective on the last day of the current month's billing cycle. You must pay for all outstanding charges at the time of termination, including the monthly access fee in full. Access fees will not be prorated upon termination.

To cancel contract services whose duration exceeds one month, you may only terminate at the end of your contracted term. Attempts to cancel prior to the end of your contracted term will result in the assessment of an early termination penalty per the terms of your contract. All contracted dedicated circuits including, but not limited to, T1, DS3, and all business dedicated wireless internet connections - require a minimum of 45 days cancellation notice submitted to QX.net in writing. The account may only be closed if the account balance is $0. No exceptions will be made.

QX.net Voice Services

All QX.net Voice users will be responsible for calling charges and fees when usage is in excess of contracted terms. This includes, but is not limited to, excess usage of International Long Distance and Nationwide Long Distance calling. QX.net Voice users must ensure to guard against fraudulent usage related to the lack of security surrounding the users phone system, PBX, phones, or any other system terminating and/or originating voice traffic. QX.net reserves the right to suspend services at our discretion. Voice taxes and fees will adjust periodically.

QX Cable Modem Users

By default, all QX Cable Modem residential accounts have a twelve (12) month minimum contract. Should the user terminate services prior to the twelve (12) month contract period, a one-time fee of $199 will be assessed to the users account. The user must also return any equipment supplied by QX.net or its contractors. Failure to return this equipment may result in additional fees being applied. All users must provide QX.net with a 30 day notice upon cancellation of services.

By default, all QX Cable Modem business accounts have a twelve (12) month minimum contract. Should the user terminate services prior to the twelve (12) month contract period, a one-time fee of $299 will be assessed to the users account. The user must also return any equipment supplied by QX.net or its contractors. Failure to return this equipment may result in additional fees being applied. All users must provide QX.net with a 30 day notice upon cancellation of services.

You may not:

  • Do anything illegal or anything that adversely affects QX.net's legal interests.
  • Share your password with anyone or allow anyone else to use your personal use account except in your immediate presence, nor dial in to our access servers from more than one modem (or ISDN device) at a time.
  • Tamper with other accounts, or commit unauthorized intrusion into any part of QX.net's system or use any of QX.net's network, machines, files or accounts to intrude without authorization into any other system (cracking). Port scanning may also be considered unauthorized intrusion.
  • Use QX.net services not included in your subscription or devise ways to circumvent security so you have access to services you haven't paid for (theft of services).
  • Use the system (willfully or negligently) in a manner that encumbers disk space, processors or other system resources so as to interfere with others' normal use of services on QX.net or on other systems (a "denial of services" attack).
  • Create or participate in chain letters or pyramid schemes.
  • Harass users (on QX.net or elsewhere). Sending email or real-time messages to a user who has asked explicitly and unambiguously that you not do this is harassment. In some cases, a harassing user may be warned against engaging in similar behavior with other users as well.
  • Harass QX.net personnel or representatives or by other means keep them from proceeding in their corporate duties thereby degrading the level of service for all customers either maliciously or intentionally. This may include but is not limited to: repeated calls to QX.net for issues not related to QX.net service, profanity and/or abusive behavior directed at or while in discussion with QX.net personnel. Verbally or by other means threatening any QX.net personnel. In some cases, a harassing user may be warned against engaging in further behavior.
  • Send unsolicited mass mailings or unsolicited subscriptions with a "negative option" for continuation. (The negative option is one where you invite people who do not wish to receive further mailings to reply to you.) If you use a mass mailing from another site to promote a service that we host, we may disable that service.

Also, we reserve the right to terminate your account without refund for other kinds of nontrivial misbehavior, although in our entire history we have never terminated an account for reasons other than those listed here. In all of these matters, decisions by QX.net staff are final.

We reserve the right to amend these rules without prior notice. We will keep a current copy of the rules in the Terms of Service section for users to reference. (We tend not to make many changes, and when we do we generally make them known by posting them on the home page and/or in customer newsletters.)
